Welcome to the Pique Pic app! By accessing or using this app, you agree to abide by these Terms of Use. Please read them carefully. If you disagree with any part of these terms, you should not use our app.

By using our app, you agree to comply with these terms and conditions, as well as any applicable laws and regulations. If you do not agree with these terms, you must cease using the app immediately.

Not to upload, share, or distribute any content that is illegal, harmful, or offensive.
To use the app only for personal, non-commercial purposes unless explicitly authorized by us.

The content, software, and design of this app, including the puzzle images, functionality, and branding, are protected under intellectual property laws. All rights are reserved by the developers of the app. You may not reproduce, copy, modify, or distribute any part of the app without explicit permission.

4. User-Generated Content

Some features of the app may allow you to upload images or content for puzzle creation. By uploading content:

You affirm that you own the content or have the necessary permissions to use and share it.
You grant us a non-exclusive, royalty-free, worldwide license to use, modify, and display your content solely for the purpose of operating, enabling, and improving the app’s functionality. We do not have any interest in retaining, analyzing, or distributing your images beyond what is necessary for the app to perform its intended features, such as scrambling, unscrambling, and sending puzzles.

5. Notifications

Our app may send notifications to remind you to engage with the app, inform you about new features, or provide important updates. Notifications are opt-in and require your explicit permission. You can manage or disable notifications at any time through your device settings.

6. In-App Purchases

The app may offer premium features through in-app purchases. All transactions are processed through the Apple App Store, and we do not store or have access to your payment details. By completing a purchase, you agree to Apple’s terms and conditions. Refunds and payment disputes must be addressed through the Apple App Store.

The scrambling feature is designed to provide an additional layer of privacy and make your images less recognizable to automated systems, crawlers, or malicious actors. 8. Disclaimer and Limitation of Liability

While the scrambling feature is designed to add an additional layer of security to your images, we make no guarantees or representations that it will prevent unauthorized access, interception, or theft of your images under all circumstances. You acknowledge that no system or technology can guarantee absolute security, and by using this app, you accept this inherent limitation.

We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the app, including but not limited to loss of data, unauthorized access, or breaches of privacy.

We may update these terms from time to time. The most current version will always be available within the app. By continuing to use the app after any changes, you accept the new terms.

10. Governing Law

These terms are governed by and construed in accordance with the laws of Canada. You agree that any legal action or dispute will be brought exclusively in the courts of Ontario.

11. User Responsibilities for Apple ID Integration

To access premium features or in-app purchases, you may be required to use your Apple ID. By using your Apple ID, you acknowledge that Apple’s privacy policy and terms of use govern your account and related data. We do not store or have access to your Apple ID credentials.

All content, software, and design elements of the Pique Pic app and website, including text, graphics, logos, images, and code, are the exclusive property of Pique Pic and RE-VU Group Inc. and are protected under international copyright laws. Unauthorized reproduction, modification, distribution, or display of this content is strictly prohibited.

14. SMS and Service Provider Charges

The app includes features that allow users to send images or messages via SMS or MMS. These messages are sent using your device’s default messaging service, which may be subject to fees or charges imposed by your mobile service provider. By using this feature, you acknowledge and agree that:

You are solely responsible for any SMS, MMS or data charges incurred by your service provider.
We are not responsible for any fees, charges, or limitations imposed by your service provider related to the use of this feature.
You should contact your service provider to understand the terms of your SMS, MMS and data plan before using this feature.

15. Prohibited Activities

When accessing or using our app or website, you agree not to engage in any of the following activities, which are strictly prohibited and may result in immediate termination of access and legal action:

Using bots, crawlers, scrapers, or other automated methods to extract data, access, or manipulate the app or website without our prior written consent.
Attempting to bypass security features, gain unauthorized access to the app or its associated servers, or disrupt the functionality of the app or website.
Hijacking or attempting to hijack traffic, functionality, or content for malicious or unauthorized purposes, including framing, spoofing, or redirecting links.

These activities constitute violations of these Terms of Use and applicable laws, including but not limited to intellectual property laws, privacy laws, and computer crime statutes. We reserve the right to monitor usage, report violations to appropriate authorities, and pursue civil or criminal legal action as necessary.
